Filing 17 DECISION AND ORDER Defendants' motion for summary judgment 11 is granted in part and denied in part. All claims against the Rochester Police Department are dismissed. Plaintiff's first, third, and fifth causes of action are dismissed. In all other respects, defendants' motion is denied.Plaintiff's cross-motion for leave to amend/correct the complaint 13 is granted in part and denied in part. Plaintiff shall file an amended complaint within fourteen (14) days of the date of entry of this Decision and Order, naming Officer Jeffrey Kester in place of the "John Doe" defendants in the original complaint, and asserting only claims of excessive force, as now alleged in the second and fourth causes of action in the original complaint.
