Filing 30 DECISION AND ORDER granting in part and denying in part 26 Motion to Amend or Correct; granting in part and denying in part 17 Motion to Dismiss for Failure to State a Claim. Defendants' motion to dismiss [#17] and Plaintiff's cross- motion to amend [#26] are both granted in part and denied in part as follows: the Second Amended Complaint [#26-2] is now the operative pleading; the request to dismiss the first cause of action is denied; the request to dismiss the third and fourth causes of action is granted; and the request to dismiss the second cause of action is granted as to Monroe County but denied as to the remaining defendants named in that claim. The Clerk of the Court is directed to terminate Monroe County as a party to this action.
