Date Filed Document Text
September 11, 2019 Filing 5 NOTICE of Appearance by James Lawrence Burgess on behalf of Commissioner of Social Security (Burgess, James)
August 28, 2019 Filing fee: $ 400, receipt number ROC011666 (TF)
August 23, 2019 Filing 4 TEXT ORDER denying #2 Motion for Leave to Proceed in forma pauperis as incomplete. Plaintiff indicates that she is not employed, and does not receive government benefits. She resides with her husband and two grandchildren, all of whom receive government benefits in the amount of $2614 used to support the family. Plaintiff's monthly expenses, however, appear to be incomplete. She lists her household expenses to be $800 per month, but does not indicate what her family spends on rent and if there are any additional expenses, besides food and utilities, associated with her care for the two grandchildren that reside with her. Based on the lack of sufficient information, the Court cannot determine whether plaintiff has set forth sufficient indications of indigency, thus, plaintiff's in forma pauperis motion is DENIED. Plaintiff has until September 22, 2019 to (1) re-file his application using the Court's standard form with all of the relevant information included, or (2) pay the $400.00 filing fee. If plaintiff has not complied with either of these options by September 22, 2019, the Clerk of Court is directed to dismiss this case without prejudice and without further order. Signed by Hon. Frank P. Geraci, Jr. on 8/23/19. (NNR)
