August 19, 2020 Opinion or Order Filing 9 TEXT ORDER: The Court closed this case for failure to pay the filing fee or submit a properly supported motion for in forma pauperis status. On August 5, 2020, the Court received a letter from Petitioner indicating that a check for the filing fee was enclosed with the letter. The Court received the letter unsealed and no check was enclosed. The Court therefore entered a 7 TEXT ORDER indicating that the matter remains closed. On August 18, 2020, the Court received a letter from Petitioner asserting that the failure to include a check for the filing fee along with the August 5, 2020 letter was due to an error on the part of the business office at Elmira Correctional Facility. Petitioner requests that the case be reopened and that, "upon said granting of Petitioner's request, Petitioner will resubmit the five ($5.00) dollar filing fee, and write the Superintendent of Elmira Correctional Facility prior thereto by informing said Superintendent of the business Office error, and to make sure said filing fee gets paid." Though the failure to include the filing fee may have been an error on the part of the Correctional Facility's business office, this case may not be re-opened until the Court receives from Petitioner either (1) a motion to proceed in forma pauperis; or (2) the $5.00 filing fee. Petitioner has thirty days from the date of this Text Order to submit such a motion or the filing fee should he wish to re-open this action. SO ORDERED.
