Plaintiff's application to proceed in forma pauperis is denied without prejudice, and it is further ordered that the Clerk of the Court shall administratively terminate this action without filing the complaint or assessing a filing fee, and it is further ordered that the Clerk of the Court shall sent to plaintiff a form motion to proceed in forma pauperis with supporting affirmation, and it is further ordered that if plaintiff wishes to reopen this action, he shall so notify this Court in writing, no later than 30 days from the date of this order, and it is further ordered that upon plaintiff's submission of either the motion to proceed in forma pauperis or the filing fee, the Clerk of the Court shall reopen this case without further order. The Clerk of Court is further directed to mail a copy of this order to Plaintiff and note service on the docket. Whether Plaintiff should be permitted to proceed further without prepayment of fees is a determination to be made by the transferee court. A summons shall not issue from this Court. This order closes the case in the Southern District of New York. The Court certifies, under 28 U.S.C. 1915(a)(3), that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
