Filing 5 TEXT ORDER denying #3 Motion for Leave to Proceed in forma pauperis as incomplete. Plaintiff indicates that she is not employed, and that she has not received any gifts, inheritance, pensions, or dividends in the last 12 months. She also indicates that she contributes $100 per month towards a minor child, who resides with her. It is unclear, however, what sources of income plaintiff receives to make such monthly contribution as her application is silent with respect to income or government assistance she receives. It is also silent as to any expenses that she incurs on a monthly basis. Based on the lack of sufficient information, the Court cannot determine whether plaintiff has set forth sufficient indications of indigency, thus, plaintiff's in forma pauperis motion is DENIED. Plaintiff has until November 29, 2021 to (1) re-file her application using the Court's standard form with all of the relevant information included, or (2) pay the $402.00 filing fee. If plaintiff has not complied with either of these options by November 29, 2021, the Clerk of Court is directed to dismiss this case without prejudice and without further order. Plaintiff is encouraged to use the Court's standard in forma pauperis motion form that can be found at https://www.nywd.uscourts.gov/opening-your-case-checklist. Signed by Hon. Elizabeth A. Wolford on 10/25/21. (NNR)-CLERK TO FOLLOW UP- |
