March 2, 2022 Opinion or Order Filing 44 ORDER granting in part and denying in part #43 Letter Motion for Extension of Time. In the attached letter motion dated March 1, 2022, defendants request an adjournment of their time to respond to plaintiffs complaint (Doc. #1) and supplemental complaint (Doc. #41), from March 8, 2022, to April 8, 2022. (Doc. #43). Defendants request the adjournment to allow sufficient time for the newly added defendants named in the supplemental complaint to review and respond to plaintiffs allegations. In a letter dated February 23, 2022, plaintiff opposes defendants' request because of the unspecified "irreparable harm" that would result from granting the request. (Doc. #42). Plaintiff requests that, in the event the Court adjourns defendants' time to respond to plaintiffs pleadings, the Court issue a "temporary injunction [till case is decided] to prohibit Defendants from moving Petitioner to moderate risk [instead allowing him to complete just low-risk] and not force him to lie/provide any untrue facts." (Id.) For substantially the reasons stated in defense counsel's letter, defendants' request for an adjournment of their time to respond to plaintiffs pleadings is GRANTED. Plaintiffs request for a "temporary injunction" is DENIED. To the extent plaintiff again moves for a preliminary injunction under Fed. R. Civ. P. 65, plaintiff has provided no new facts or arguments demonstrating that he (i) is likely to succeed on the merits of the case, or (ii) will suffer irreparable harm if he is not awarded the "extraordinary and drastic remedy" of preliminary injunctive relief. See Moore v. Consol. Edison Co. of N.Y., Inc., 409 F.3d 506, 510 (2d Cir. 2005) (internal quotation marks and citation omitted). Accordingly, it is HEREBY ORDERED: By April 8, 2022, defendant shall answer, move, or otherwise respond to plaintiffs complaint and supplemental complaint. The Clerk is directed to terminate the letter motion. (Doc. #43). January 12, 2022 Opinion or Order Filing 37 ORDER: Having reviewed plaintiff's motion for a preliminary injunction, the Court finds plaintiff has provided no new facts or arguments demonstrating that he (i) is likely to succeed on the merits of his case, or (ii) will suffer irreparable harm if he is not awarded the extraordinary and drastic remedy of preliminary injunctive relief. Accordingly, plaintiff's motion for a preliminary injunction is DENIED. Nevertheless, in light of the additional allegations contained in plaintiff's motion, and given the early stage of this case, the Court will GRANT plaintiff leave to supplement the complaint pursuant to Fed. R. Civ. P. 15(d), for the limited purpose of including the additional allegations contained in the motion and naming the additional defendant referenced in the motion. If appropriate, the Court will cause an additional summons to be issued with respect to the additional named defendant, and plaintiff will be obligated to serve the summons and complaint (including the supplemental pleading) on the newly-named defendant. Accordingly, the time for all defendants to answer, move, or otherwise respond to the complaint is STAYED pending the filing of plaintiff's supplemental pleading, at which point defendants shall answer, move, or otherwise respond to the complaint (including the supplemental pleading) within 21 days. Plaintiff is reminded that because he is not proceeding in forma pauperis, it is his responsibility to comply with the applicable service requirements with respect to any additional defendant. Finally, plaintiff's request for a protective order regarding the inmate affidavits is DENIED. As the Court has repeatedly informed plaintiff, it is plaintiff's responsibility to serve the summons and complaint on defendants. If defendants have not returned their signed acknowledgment of receipt of service (assuming, without deciding, that plaintiff's attempt to serve via mail otherwise complies with C.P.L.R. 312-a), then service is not complete under 312-a, and plaintiff must resort to other appropriate methods of service. See, e.g., Prokopiou v. Long Island R. Co., 2007 WL 1098696, at *6 (S.D.N.Y. The case may go forward against the State of New York (incorrectly sued as DOCCS, the New York State Board of Parole, and the New York State Board of Examiners for Sex Offenders) only for injunctive relief under RLUIPA. See Sossamon v. Texas, 563 U.S. 277 (2011) (holding that states do not waive their sovereign immunity to suits for money damages under RLUIPA). However, plaintiff's claims against the State of New York (incorrectly sued as DOCCS, the New York State Board of Parole, and the New York State Board of Examiners for Sex Offenders) under Section 1983 and for monetary damages under RLUIPA remain dismissed. July 27, 2021 Opinion or Order Filing 11 ORDER: The Court is in receipt of two letters from plaintiff, dated July 19 and July 20, 2021. The letters will be separately docketed. In the July 19 letter, plaintiff requests that the Court "issue an Order to protect him from Retaliation, Harassment, Intimidation, Abuse, Injury and loss of benefits by the Defendants, and others instigated by the Defendants, due to [plaintiff's] viable lawsuits." The request is DENIED. Having reviewed the conclusory and self-serving allegations in plaintiff's July 19 letter, the Court finds that plaintiff has failed to establish a basis for any of the relief requested therein. In the July 20 letter, plaintiff again requests that that he be allowed to rely on the U.S. Marshals Service to effect service on defendants, a request the Court has previously denied. As the Court explained, plaintiff is not proceeding in forma pauperis and is therefore not entitled to rely on the Court and the U.S. Marshals Service to effect service. It is plaintiff's responsibility to serve the summons and complaint on defendants within 90 days of the issuance of the summons. Nothing in plaintiff's letter provides a basis for reconsideration of the Court's previous order. Accordingly, plaintiff's request is again DENIED. In addition, plaintiff improperly addressed this mailing to Judge Briccetti's Chambers. Briccetti from Sanjay Tripathy dated 7/2/2021 re: Petitioner request the Court to allow him to use the Marshalls service for the summons. ENDORSEMENT: Plaintiff, who is currently incarcerated in Fishkill Correctional Facility, brings this prose action, for which the filing fee has been paid, alleging that defendants violated his federal constitutional rights. On June 30, 2021, the Court issued an Order of Service (i) denying plaintiffs request for preliminary injunctive relief; (ii) dismissing plaintiffs claims against DOCCS, the New York State Board of Examiners for Sex Offenders, and the New York State Parole Board; and (iii) directing the Clerk of Court to issue summonses as to defendants Feuz, Reid, Gonzalez, Wood, Burnett, McKay, Stanford, Harrington, and Cuomo. (Doc. #3). In the attached letter dated July 2, 2021, plaintiff notified the Court that defendant Annucci was not included in the order of service and requesting that the Court "add Defendant Annucci to its Order for the summons." Plaintiff also requests that he be allowed to rely on the Court and the U.S. Marshals Service to effect service. By separate order, the Court has granted plaintiffs request to add defendant Annucci and has directed the Clerk of Court to issue a summons as to defendant Annucci. Regarding plaintiffs request that he be allowed to rely on the Court and U.S. Marshals Service to effect service, 28 U.S.C. 1915(d) permits a plaintiff who has been granted permission to proceed IFP to rely on the Court and the U.S. Marshals Service to effect service. 28 U.S.C. 1915(d) ("The officers of the court shall issue and serve all process... in [IFP] cases."); see also Walker v. Schult, 717 F.3d. 119, 123 n.6 (2d Cir. 2013). Here, plaintiff has elected not to seek in forma pauperis status and has paid the full filing fee. Accordingly, plaintiffs request is DENIED. To be clear, it is plaintiffs obligation to arrange for service of process.
