December 16, 2022 Opinion or Order TRANSFER ORDER: Plaintiff Andrew W. Baxter, currently incarcerated at Eastern Correctional Facility, brings this pro se action pursuant to 42 U.S.C. 1983 concerning events that allegedly occurred at Attica Correctional Facility on May 4, 2022. Because Plaintiff's claims relate to events and Defendants that are located in Wyoming County (where Attica Correctional Facility is located), this Court is not the appropriate court in which to file this action. "[W]hether venue is wrong or improper is generally governed by 28 U.S.C. 1391." Atl. Marine Const. Co., Inc. v. U.S. Dist. Ct. for W.D. of Tex., 571 U.S. 49, 55 (2013) (internal citation and quotations omitted). Here, Plaintiff has not shown that the Eastern District of New York is the proper venue under either Sections 1391(b)(1) or 1391(b)(2). Under Section 1391(b)(1), venue is proper in "a judicial district in which any defendant resides, if all defendants are residents of the State in which the district is located in." 28 U.S.C. 1391(b)(1). Here, Defendants are located in Attica, NY. (Dkt. 1, at 2.) Thus, venue is not proper in this district pursuant to Section 1391(b)(1). Under Section 1391(b)(2), venue is proper in a judicial district "in which a substantial part of the events or omissions giving rise to the claim occurred." Here, Plaintiff's claims relate to alleged events that occurred in Attica Correction Facility. (Dkt. 1, at 3-4.) Thus, venue is also not proper under Section 1391(b)(2). A district court may "if it be in the interest of justice, transfer such case to any district or division in which it could have been brought." 28 U.S.C. 1406(a). Accordingly, in the interest of justice, the Clerk of Court is hereby directed to transfer this action to the United States District Court for the Western District of New York. 28 U.S.C. 112(d); 1406(a). The decision on Plaintiff's application to proceed in forma pauperis pursuant to 28 U.S.C. 1915 and enforcement of the Prison Litigation Reform Act is reserved for the transferee Court. That provision of Local Rule 83.1 which requires a seven-day stay is hereby waived. Summonses shall not issue from this Court. The Clerk of Court is directed to mark this case closed, and to mail a copy of this Transfer Order to Plaintiff. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. Coppedge v.
