TEXT ORDER: The Court has received a letter from Plaintiff, dated June 21, 2023, again requesting electronic filing access. Plaintiff further explains the basis for her request. She lives more than one hour from the courthouse and is concerned about meeting filing deadlines when using mail. Recently, Plaintiff paid a messenger to file documents to ensure that she did not miss a filing deadline. Plaintiff also states that she has the necessary skills to use the electronic filing system.Based on Plaintiff's further explanation, the Court GRANTS Plaintiff electronic-filing access in the present case. In order to obtain electronic-filing access, Plaintiff shall:1.Submit a CM/ECF Registration Form to the Clerk's Office (the Court will forward a copy of this form to Plaintiff with this Text Order);2.Review the Administrative Procedures Guide for Electronic Filing (available at the following link: https://www.nywd.uscourts.gov/rules-individual-local-federal); and3.Request electronic filing access through PACER (available at the following link: https://pacer.uscourts.gov/register-account/non-attorney-filers-cmecf). The Court cautions Plaintiff that, under the Western District of New York's Administrative Procedures Guide for Electronic Filing, electronic-filing privileges may be revoked at any time. SO ORDERED. TEXT ORDER: Plaintiff has requested electronic filing access, stating that she would like to "more easily file documents in [her] case." ECF No. 8 at 1. Plaintiff's request is DENIED.Rule 5 of the Federal Rules of Civil Procedure provides that a pro se litigant "may file electronically only if allowed by court order or by local rule." Fed. R. Civ. P. 5(d)(3)(B)(i). This district's Administrative Procedures Guide for Electronic Filing provides that "[a] Judicial Officer may, at his or her discretion, grant a pro se litigant who demonstrates a willingness and capability to file documents electronically, permission to register to do so." See https://www.nywd.uscourts.gov/rules-individual-local-federal (updated Oct. 5, 2022) (emphasis in original).In this case, Plaintiff articulates no persuasive reason that she needs electronic-filing access, and she has previously had no trouble litigating this matter via mailed filings. Accordingly, the Court declines to exercise its discretion to allow Plaintiff to use the Court's electronic filing system. Accord Akande v. Philips, 386 F. Supp. 3d 281, 296 (W.D.N.Y. 2019).
