July 5, 2023 Filing 10 TEXT ORDER denying as moot Plaintiff's motion to appoint counsel [ECF No. 5]. On May 25, 2023, the Court entered an order denying without prejudice Plaintiff's renewed application for leave to proceed in forma pauperis [ECF No. 4], and granted Plaintiff 30 days from the entry of the Order to either (1) submit a signed supporting affirmation and certification; (2) submit a signed supporting affirmation with an additional affidavit describing the refusals of prison officials to sign the certification section, including dates on which Plaintiff requested the certification and names of officials who refused to sign the certification section; or (3) pay the filing fees totaling $402.00. The Court advised that if Plaintiff failed to comply with the deadline, the case would be dismissed without prejudice. The deadline has since passed, and Plaintiff's complaint has been dismissed without prejudice. Plaintiff's motion to appoint counsel [ECF No. 5] is therefore denied as moot. Signed by Hon. Charles J. May 25, 2023 Opinion or Order Filing 8 ORDER denying #4 Motion for Leave to Proceed in forma pauperis. Plaintiffs renewed application for leave to proceed in forma pauperis [ECF No. 4] is denied without prejudice. The Clerk of Court shall administratively terminate this action without filing the Complaint or assessing a filing fee. The Court will grant Plaintiff a final opportunity to fix his errors, and Plaintiff has until 30 days from the entry of this Order to either (1) submit a signed supporting affirmation and certification; (2) submit a signed supporting affirmation with an additional affidavit describing the refusals of prison officials to sign the certification section, including dates on which Plaintiff requested the certification and names of officials who refused to sign the certification section; or (3) pay the filing fees totaling $402.00. If Plaintiff fails to comply with this deadline, this case will be dismissed without prejudice. To assist Plaintiff, the Clerk of Court shall send to Plaintiff a blank Motion requesting to proceed in forma pauperis. This writing must include either: (1) a motion to proceed in forma pauperis with the supporting affirmation, certification of Plaintiff's inmate trust fund account (or the institutional equivalent), and signed authorization form; or (2) the $350.00 filing fee and the $52.00 administrative fee ($402.00 total); and it is further ORDERED that upon Plaintiffs submission of either: (1) a motion to proceed informa pauperis with supporting affirmation, certification of inmate trust fund account, and authorization form; or (2) the $350.00 filing fee and the $52.00 administrative fee ($402.00 total), the Clerk of Court shall reopen this case without further order.
