Filing 5 NOTICE of Appearance by Padma Ghatage on behalf of Commissioner of the Social Security (Ghatage, Padma) |
Filing 4 TEXT ORDER denying #2 Motion for Leave to Proceed in forma pauperis as incomplete. Plaintiff indicates that he is not employed, receives public assistance in the amount of $503.00 per month, and shares the household with his spouse who receives disability in the amount of $1,180 per month. Plaintiff owns real estate in the amount of $80,000 and two vehicles. Plaintiff estimates his monthly household expenses to be $2,261.70, and it is unclear what additional sources of income, if any, he uses to cover his monthly expenses with the income he and his spouse receive. Therefore, based on the lack of sufficient information, the Court cannot determine whether plaintiff has set forth sufficient indications of indigency. Thus, plaintiff's in forma pauperis motion is DENIED. Plaintiff has until November 6, 2023, to (1) re-file his application using the Court's standard form with all of the relevant information included, or (2) pay the $402.00 filing fee. If plaintiff has not complied with either of these options by November 6, 2023, the Clerk of Court is directed to dismiss this case without prejudice and without further order. Signed by Hon. Elizabeth A. Wolford on 10/6/23. (NNR)Clerk to Follow up |
