March 26, 2024 Filing 8 TEXT ORDER: Plaintiff has filed a motion for summary judgment "in opposition to [Defendant's] [notice] of removal." ECF No. 7 at 1. To the extent that Plaintiff seeks summary judgment, where, as here, there has been no discovery, such a motion is premature. See Thompson v. New York State Corr. & Cmty. Supervision, No. 22-CV-6307, 2023 WL 6499443, at *1-2 (W.D.N.Y. Oct. 5, 2023). However, because Plaintiff styles her motion as one in opposition to Defendant's notice of removal, the Court construes the motion as one for remand. Defendant shall respond to Plaintiff's motion by April 9, 2024. Plaintiff may file a reply within seven days after Defendant has filed its response.The parties are directed to continue to engage in discovery and other pretrial matters while Plaintiff's motion is pending.
