Filing 9 TEXT ORDER: The Court orders that this case proceed to pre-discovery mediation in accordance with the plan set forth at the December 13, 2022 status conference. See, e.g., Boehner v. City of Rochester, No. 21-CV-6574, ECF Nos. 50, 51. Consistent with that plan, Steven Modica is designated mediator in this case. The mediation shall proceed in accordance with the protocols of the prior mediations in related cases. The parties are directed to promptly meet and confer with the mediator to set the first mediation session. The mediator may attempt to resolve any mediation discovery-related disputes, should they arise. Fees and costs must be part of any final settlement.
