May 8, 2024 Opinion or Order Filing 3 ORDER TRANSFERRING CASE: For the reasons stated in the attached Order, the Clerk of Court is directed to transfer this action, in the interest of justice, to the United States District Court for the Western District of New York. See 28 U.S.C. 112(d), 1406(a). No summons shall issue from this Court. The Court notes that a decision on Plaintiff's #2 pending in forma pauperis application is reserved for the transferee court. That provision of Rule 83.1 of the Local Rules of the Eastern District of New York which requires a seven-day delay is waived. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
