Filing 85 MEMORANUDM AND ORDER: 74 motion will be GRANTED IN PART and DENIED IN PART. Clerk is DIRECTED to calendar the issuance of a subpoena for Samuel Queer and Joseph Banner four weeks prior to the new trial date. The Clerk is DIRECTED to prepare and iss ue a subpoena duces tecum to the Custodian of Records of the Internal Affairs Department at STSRCF. The Clerk is further DIRECTED to forward the subpoena to the United States Marshal Service (USMS). The 78 motion is GRANTED and the Clerk is DIRECT ED to calendar the issuance of a subpoena for Gerald Brummett four weeks prior to the new trial date. 79 Motion, it is DENIED. The 81 motion is GRANTED. The Clerk is DIRECTED to send a copy of this Order along with a copy of Plaintiff's medi cal records, which are attached to the motion, to the medical department at STSRCF so that they may decipher and type the medical notes and submit the typewritten notes to Plaintiff. Plaintiff's 82 Motion for Counsel is DENIED. The Court previ ously cancelled the January 11, 2010 trial date; thus, 84 motion is DENIED as MOOT. Finally, the case is set for a JURY TRIAL on Monday, May 24, 2010 at 9:00 a.m. at the United States District Courthouse, 900 Georgia Avenue, 3rd Floor, Chattanooga, Tennessee..
