MEMORANDUM AND ORDER: Petitioner seeks a dismissal of the charges pending and release from custody, rather than the enforcement of certain procedures allegedly denied him, he seeks relief that is not available from this Court. The Court otherwise finds Petitioner has failed to exhaust his State court remedies. Accordingly, the instant petition for writ of habeas corpus is DISMISSED WITHOUT PREJUDICE, and the pending motion for appointment of counsel #5 is DENIED AS MOOT. Additionally, it is CERTIFIED that any appeal from this decision would not be taken in good faith and would be totally frivolous. Fed. R. App. P. 24.
