April 26, 2023 Opinion or Order Filing 11 ORDER: This matter is before the Court on Plaintiff Terry Posey's Motion for Preliminary Injunction [Doc. 9]. Mr. Posey filed this civil suit against Defendants on March 9, 2023, and he issued summonses to each Defendant. Some but not all of those summonses have now been returned executed. Specifically, a summons has not yet been returned executed as to the Bureau of Tobacco, Firearms, and Explosives. Under Federal Rule of Civil Procedure 4(m), however, Mr. Poseywho, again, filed his complaint on March 9, 2023still has forty-two days to effect service of process and file the requisite proof of service in the record. The Court hereby puts the parties on notice that it will take no action on Mr. Posey's motion for a preliminary injunction until he effects service on the Bureau and files the requisite proof of service.
