Filing 17 MEMORANDUM OPINION: For the reasons in this memorandum opinion, this petition will be DENIED and the case will be DISMISSED. The Court now finds that reasonable jurists could not disagree with the resolution of these claims and coul d not conclude that they are adequate to deserve encouragement proceed further, Miller-El v.
