Filing 153 MEMORANDUM OPINION AND ORDER: This matter is before the Court on the motions for summary judgment filed by all defendants, [Docs. 62, 65 and 67]. Conclusion Because the plaintiffs have failed to show standing and proximate cause in regard to their RI CO action, it is hereby ORDERED that the motions for summary judgment filed by the defendants Ken Horton, Kens Motors, Robert Dunbar, and Maynard Johnson are GRANTED and Count 1 of the plaintiffs second amended complaint is hereby DISMISSED WITH PREJUDICE. [Docs. 62, 65 and 67]. The plaintiffs state law claims are, therefore, DISMISSED WITHOUT PREJUDICE. Signed by District Judge J Ronnie Greer on 7/21/2009. (RLC) |
