Filing 11 MEMORANDUM OPINION AND ORDER, GRANTING 5 MOTION to Dismiss filed by Dr Paul. For all the reasons given, defendants motion for summaryjudgment will be GRANTED based on plaintiffs failure to state a claim for relief against him under § 1983. See 28 U.S.C. § 1915(e)(2)(B)(ii). And because plaintiff has no claim against Dr. Paul for denial of medications, clearly he has no claim for injunctive relief against the unidentified defendant CDC administrators based on being denied certain medications.
