The defendant's motion is GRANTED. As such, Triad is not entitled t o summary judgment regarding plaintiff's prima facie case. The motion in that regard is DENIED. Considering the burden shifting framework, this Court cannot find that there is a genuine issue of fact that the reasons articulated by Triad were a pretext for age discrimination.
