Filing 97 MEMORANDUM OPINION AND ORDER: For the reasons set forth in the Memorandum, the motion for summary judgment, [Doc. 87], filed by Sherry Woodby, Johnnie Wade, chuck Humphreys and Greene County Sheriff's Department is GRANTED and plaintiff's complaint and amended complaint against these defendants is DISMISSED WITH PREJUDICE. The court has already dismissed plaintiff's claims against all other defendants and the Court will now enter judgment against plaintiffs in fa vor of all defendants in the case. The Clerk is DIRECTED to TERMINATE AS MOOT defendants' motion to dismiss for failure to prosecute and plaintiff's motion, which is titled as a motion for summary judgment, [Doc. 86]. Filing 45 MEMORANDUM OPINION AND ORDER: Re 17 MOTION to Dismiss filed by Ricky Graham, Johnnie Wade, Jeff Davis, Jason - Taylor, Chuck Humphreys, Greene County Sheriff's Office, Sherry Woodby, John - Jones. For the reasons which follow , the motion will be GRANTED IN PART and DENIED IN PART and this proceeding will be STAYED pending resolution of Danielle Whites pending state criminal prosecution. To the extent plaintiffs seek such injunctive relief, it is denied and their complain t against these defendants in that respect is DISMISSED. To the extent, however, that plaintiffs seek monetary damages for violations of their constitutional rights under 42 U.S.C. § 1983 which would not shield them from prosecution under state law or implicate the potential invalidity of a state court conviction, the motion to dismiss must be DENIED. Counsel for defendants is directed to file a status report with the Court within ten (10) days of the entry of the instant order detailing the current status of the criminal prosecution of Danielle Michelle White.
