Filing 49 MEMORANDUM OPINION AND ORDER. Defendant's Motion 44 for Summary Judgment is GRANTED. For the reasons stated in this opinion, the plaintiff cannot establish that there was an underlying constitutional violation. Therefore, the Court need not address whether the plaintiff could prove that a policy or custom of Greene County was a moving force in causing the alleged constitutional violation.
