MEMORANDUM OPINION AND ORDER: For the reasons stated above, the plaintiff cannot establish that there was an underlying constitutional violation. Therefore, the Court need not address whether the plaintiff could prove that a policy or custom of Johnson City was a moving force in causing the alleged constitutional violation. As such, the defendants Motion to Dismiss or, in the Alternative, for Summary Judgment, [Doc. 33], is GRANTED. The case will be DISMISSED on the merits.
