Filing 6 MEMORANDUM AND ORDER: The Claiborne County Detention Center is DISMISSED as a Defendant and all claims against the CDCD are DISMISSED for failure to state a claim. Plaintiff has not stated a claim against Defendants Martin and Rhea in their official capacities, and they and all claims against them are DISMISSED from this suit. Unless within 30 days of the date on this Order, Plaintiff amends his claims to cure the specific cited failings, the Court will DISMISS this case for fa ilure to state a claim for relief, without providing further notice to Plaintiff. Filing 3 MEMORANDUM AND ORDER: Because Plaintiff is an inmate in the CCDC, he is ASSESSED the civil filing fee of $350.00. The Clerk is DIRECTED to send a copy of this order to the Sheriff of Claiborne County, Tennessee, and to the CC DC Jail Administrator. The Clerk is further DIRECTED to forward a copy of this order to the Court's financial deputy. The Court therefore concludes that this case more properly belongs in the United States District Court for the Eastern Dist rict of Tennessee at Knoxville, which comprises the Northern Division, and accordingly will order that this action be transferred to that division, "in the interest of justice."
