August 24, 2010 Opinion or Order Filing 170 ORDER granting 81 Hartford's Motion for Partial Summary Judgment on its Contractual Indemnity Claim and denying 96 Ms. Asher's Motion for Summary Judgment on the Contractual Indemnity Claim. Pursuant to Article III of the 2002 Indemnity Agreement, Ms. Asher and Mr. Crowe are jointly and severally liable for indemnifying Hartford for the losses, costs, and attorneys' fees it sustained in furnishing Bonds to complete CMC's unfinished construction projects, and for settling claims related to those Bonds. Hartford is ORDERED to provide an updated list of all payments it has made in settling claims related to the Bonds and/or to complete CMC's construction projects. This list must be filed with the Court by SEPTEMBER 24, 2010. The Motions for Summary Judgment on the Fraudulent Transfer Claims 84 and 94 are DENIED AS PREMATURE, with leave for the parties to re-file motions for summary judgment after considering the recently filed exhibits. F inally, Hartford's Motion for Partial Summary Judgment on its Fraudulent Transfer Claim 84 is DENIED, to the extent that it seeks to pierce the corporate veil of the Partnership through the "reverse piercing" doctrine. February 12, 2010 Opinion or Order Filing 140 ORDER granting 138 Tara Asher's Motion to Amend her Cross-Complaint, whereby Tara Asher is granted leave pursuant to Rule 15 of the Federal Rules of Civil Procedure to file an amended cross-claim containing a request for puni tive damages against Jerry Crowe. Pursuant to Local Rule 15.1, Tara Asher shall file the amended cross-claim against Jerry Crowe in its entirety within ten days of entry of this order.
