ORDER that the Court ACCEPTS IN WHOLE the Report and Recommendation 17 , and DENIES plaintiffs motion/application for leave to proceed in forma pauperis 14 . In addition, this Court has carefully reviewed this case pursuant to 28 U.S.C. § 1915(a) and hereby CERTIFIES, pursuant to 28 U.S.C. § 1915(a)(3), that any appeal in this matter by plaintiff would not be taken in good faith and plaintiff may not proceed on appeal in forma pauperis.
