ORDER that plaintiff's Motion for Summary Judgment 10 is hereby GRANTED IN PART and DENIED IN PART and the Commissioner's Motion for Summary Judgment 12 is GRANTED IN PART and DENIED IN PART. It is ORDERED that this ca se be REMANDED to the ALJ to: (1) explain the weight accorded to the opinion of plaintiff's treating physician, Dr. Smith, and the reasons for according such weight, and (2) reevaluate whether Mr. Hankins's August 23, 2011 opinion is consistent with and supported by the evidence of record in light of the ALJ's explanation for the weight accorded to Dr. Smith.
