Filing 13 MEMORANDUM AND ORDER: Giving due regard to Petitioner's status as a pro se litigant, this Court finds that the Complaint contains sufficient factual averments that, if true, state a claim to relief that is plausible on its face under the Eighth Amendment. As such, Defendant, SHP's motion to dismiss [Doc. 4] is DENIED in part as to the alleged Eighth Amendment violations.
