Should Petitioner give timely notice of an appealfrom this Order, such notice will be treated as an application for a certificate of appealability,whic h is hereby DENIED since he has failed to make a substantial showing of the denial of aconstitutional right or that jurists of reason would find it debatable whether the petition states avalid claim of the denial of a constitutional right and that ju rists of reason would find it debatablewhether the district court [is] correct in its procedural ruling.
