September 5, 2019 Opinion or Order Filing 6 MEMORANDUM OPINION AND ORDER: It appears from the motion for leave to proceed in forma pauperis that Plaintiff lacks sufficient financial resources to pay the filing fee. Accordingly, this motion [Doc. 1] will be GRANTED. Because Plaintiff is an inmate in the Morgan County Correctional Complex, he will be ASSESSED the civil filing fee of $350.00. the Clerk will be DIRECTED to mail a copy of this memorandum and order to the custodian of inmate accounts at the institution where Plaintiff is now confined, and to the Attorney General for the State of Tennessee. The Clerk also will be DIRECTED to provide a copy to the Court's financial deputy. Plaintiff's motion is premature, as no Defendant has appeared in this action. Therefore, the motion seeking production of documents [Doc. 4] is DENIED without prejudice to Plaintiff's ability to later seek the Court's intervention if he is unable to resolve his discovery requests with any appearing Defendant(s). Plaintiff's claim that Defendant Hacker subjected him to excessive force, and that Defendant Johnson failed to protect him from such use of force, shall PROCEED. Defendants Tony Parker and Mike Parris are DISMISSED. The Clerk is hereby DIRECTED to send Plaintiff service packets (a blank summonsand USM 285 form) for Defendants Johnson and Hacker.
