ORDER, the Court construes this filing as a federal habeas petition seeking relief pursuant to 28 U.S.C. 2241, which applies to persons challenging their custody prior to their conviction. Accordingly, the Clerk is DIRECTED to categorize this proceeding as an action arising under 28 U.S.C. 2241, and to mail Mitchell a 2241 form, which Mitchell is ORDERED to complete and return to this Court within twenty-one (21) days of entry of this Order. Moreover, it is apparent from the inmate trust fund affidavit filed with Mitchell's motion for leave to proceed in forma pauperis that he has $61.47 in his account [Doc. 4 p. 2], which is more than sufficient to pay the $5.00 filing fee in this matter. Accordingly, Mitchells motion to proceed in forma pauperis #4 is DENIED, and he is ORDERED to pay the $5.00 filing fee within twenty-one (21) days of entry of this order.
