Now before the Court is Defendant Sarah Kirkland's Motion to Strike and Memorandum of Law in Support Thereof [Doc. 41]. After the motion was filed, Plaintiffs and Defendant Kirkland filed a joint motion for an agreed order, stating that Defendant Kirkland agrees to withdraw the motion to strike based on the parties' agreement as set forth in their proposed agreed order [Doc. 73]. Judge Corker entered the Agreed Order to modify the asset freeze as it pertains to Defendant Kirkland [Doc. 75]. The Agreed Order also provides that Plaintiffs will amend their Complaint "by deleting paragraph 106 and altering paragraph 109 to remove any reference to Ms. Kirkland" [Id. at 4].
