ORDER denying #31 Motion to Stay. This matter is before the Court on pro se Plaintiff Tristan J. Halls Motion to Stay [Doc. 31], in which Mr. Hall moves the Court to stay this action because he has been incarcerated "based solely on the Defendant's ill gotten capias." He seeks a stay until he is released, but he does not provide the Court with a release date. Mr. Hall fails to identity grounds for a stay that rest in sound legal principles. The fact that he is now incarcerated is inconsequential because prisoners routinely file and litigate cases from within the prison system. Mr. Hall therefore fails to meet his burden as the movant for a stay and his motion [Doc. 31] is DENIED. Lastly, the Court would be remiss if it did not note that Mr. Hall himself did not file the motion for a stay. Instead, his mother, Debra McNaughton, filed the motion on his behalf "with permission." The Court can consider requests for relief only from an individual who is a party to a case, and that partyto obtain reliefmust either file a motion through an attorney or, if he does not have an attorney, file a motion pro se, that is, on his own behalf. Mr. Hall is hereby FOREWARNED that the Court cannot and will not consider any additional filings from his mother or any other third-party who makes filings on his behalf. If the Court receives any motions from his mother or any other third party, it will summarily deny them. Signed by District Judge J Ronnie Greer on 1/23/2024.
