Court rescinds the portion of its 11/2/08 Memorandum and Order that dismissed without prejudice plaintiff's false arrest claims arising out of his failure to display a driver's license and violation of the registratio n law. Plaintiff's 1983 false arrest claims related to these charges are reinstated. Court amends its 12/7/07 Memorandum and Order to state that the only remaining claimsre Plaintiff's Fourth Amendment claims pursuant to 1983 against defe ndants Seagraves, Hillis, John Doe Sergeant, and the City of McMinnville and Plaintiff's Fourteenth Amendment substantive due process claims pursuant to 1983 against Defendants Blake, Golden, Jane Doe #1, John Doe #2 and Warren County for any vi olations which may have occurred after Plaintiff was taken to the Warren County jail for booking. Defendants are free to amend their Motion for Summary Judgment up to the dispositive motion deadline. Copy mailed to all non-ecf parties.Signed by District Judge Harry S Mattice, Jr on 10/28/08. Filing 25 MEMORANDUM AND ORDER. Court rescinds the portion of its 11/2/08 Memorandum and Order that dismissed without prejudice plaintiff's false arrest claims arising out of his failure to display a driver's license and violation of the registratio n law. Plaintiff's 1983 false arrest claims related to these charges are reinstated.
