MEMORANDUM AND ORDER: Defendants Clay Parker and Terry Stacey's joint 57 Motion for Summary Judgment is GRANTED; and Defendants Tim Lane and Tim Miller joint 51 Motion for Summary Judgment is GRANTED IN PART and DENIED IN PART. The claims of this complaint are DISMISSED, EXCEPT FOR THE FOLLOWING CLAIMS: (1) Plaintiff's claim brought under 42 U.S.C. sec. 1983 for excessive force in violation of the Fourth Amendment against Lane and Miller in their individual capacities; and (2) Plai ntiff's claim under 42 U.S.C. sec. 1983 against Miller in his individual capacity for deliberate indifference to a serious medical need in violation of the Fourteenth Amendment..
