December 20, 2023 Opinion or Order Filing 4 ORDER: Jason Schutt, a pretrial detainee in the custody of the Lois M. DeBerry Special Needs Facility in Nashville, Tennessee, has filed a pro se complaint under 42 U.S.C. 1983, alleging violations of Plaintiff's civil and constitutional rights. (Doc. No. #1 ). Plaintiff also has filed an Application for Leave to Proceed In Forma Pauperis with a supporting inmate trust account statement. (Doc. No. #2 ). From a review of Plaintiff's Application, it appears that Plaintiff lacks sufficient financial resources from which to pay the full filing fee in advance. Therefore, his Application (Doc. No. #2 ) is GRANTED. Accordingly, Plaintiff is hereby assessed the full civil filing fee of $350. The Clerk of Court is DIRECTED send a copy of this Order to the administrator of inmate trust fund accounts at the Lois M. DeBerry Special Needs Facility to ensure that the custodian of Plaintiff's inmate trust account complies with that portion of 28 U.S.C. 1915 pertaining to the payment of the filing fee. Because the events giving rise to this action occurred in the Eastern District of Tennessee, the Court presumes that any potential witnesses are also located within the Eastern District. Accordingly, this action shall be TRANSFERRED to the Eastern District of Tennessee, Winchester Division. The required screening of the complaint is more appropriately handled by the transferee court.
