JUDGMENT ORDER re #5 MEMORANDUM AND ORDER. It is ORDERED and ADJUDGED that this prisoners civil rights action filed under 42 U.S.C. 1983 is DISMISSED for failure to state a claim upon which relief may be granted. 28 U.S.C. 1915(e)(2)(B) and 1915A. Because the Court CERTIFIED that any appeal from this Order would not be taken in good faith, should Plaintiff file a notice of appeal, he is DENIED leave to appeal in forma pauperis. MEMORANDUM AND ORDER: It appears from Plaintiff's motion for leave to proceed in forma pauperis and his accompanying trust fund account records that he cannot pay the filing fee in one lump sum. Accordingly, this motion [Doc. #1 ] is GRANTED. Plaintiff is ASSESSED the civil filing fee of $350.00. The custodian of Plaintiff's inmate trust account is DIRECTED to submit the filing fee to the Clerk in the manner set forth above. Plaintiff has failed to state a claim upon which relief may be granted, and all Plaintiff's federal claims are DISMISSED pursuant to 28 U.S.C. 1915(e)(2)(B) and 1915A; The Court declines to exercise supplemental jurisdiction over Plaintiff's state law claims, and they are DISMISSED without prejudice; and The Court CERTIFIES that any appeal from this action would not be taken in good faith and would be totally frivolous.
