April 5, 2024 Opinion or Order Filing 29 ORDER by Judge Mashburn : With regard to docket entry #22, #28, the debtor has filed a motion at Doc. 22 asking the Court to enter an agreed order rejecting a lease with the landlord, CoolSprings Mall, LLC. The proposed agreed order, submitted at Doc. 28, states that no timely objections have been filed to the motion, and yet the debtor did not provide notice under LBR 9013-1 or use any other process that would actually afford an opportunity for objections. Further, the agreed order includes additional relief beyond rejection of the lease that may affect other parties. One provision of the submitted order provides that the landlord may dispose of any remaining personal property without further notice. This provision would have the potential effect of granting the landlord superior rights to personal property that could be subject to prior liens, leases, or other types of interests or encumbrances without any objection period or opportunity for any affected party to be heard. Likewise, the submitted order provides for an administrative claim in a specified amount without any opportunity for objection. Accordingly, the order will not be entered as submitted. The parties may pursue a process that allows for appropriate notice and an opportunity to be heard under LBR 9013-1. If rejection of the lease and possession by the landlord of the leased premises are subject to critical timing concerns, LBR 9075-1 could potentially apply under certain circumstances. In any event, the Court can find no basis for granting rights to the landlord in property not covered by the lease or obtaining an administrative claim without adequate notice and an opportunity for hearing.
