Filing 17 ORDER: Accordingly, the Court rules as follows: (1) The R & R 14 is hereby ACCEPTED AND APPROVED; (2) Plaintiff's Verified Petition for Declaratory Judgment and Relief 1 is hereby DISMISSED in accordance with 28 U.S.C. § 1915(e)(2)(b) b ecause it fails to state a claim on which relief may be granted; (3) Plaintiff's Motion to Amend 3 is hereby DENIED; and (4) Any in forma pauperis appeal of this Order would not be taken in good faith. Entry of this Order on the docket shall constitute entry of a final judgment in accordance with Federal Rules of Civil Procedure 58 and 79(a). It is so ORDERED.
