October 6, 2014 Opinion or Order Filing 217 ORDER: For the reasons stated in the Court's Order granting in part Defendants' motion for summary judgment in the related action of Brandon Frazier v. Enoch George, et al., 1:12-cv-00128, the Court concludes that Defendants' moti on for summary judgment 126 is GRANTED as to Plaintiff's claims for unsanitary housing, inadequate law library, and inadequate hygiene. These claims are DISMISSED. Defendants' motion is also granted with respect to Plaintiff's cl aims for injunctive relief. These claims are DISMISSED as moot. Defendants' motion for summary judgment is DENIED in all other respects, as genuine issues of material fact with respect to Defendants' knowledge of, and participation in, the alleged violations of Plaintiff's rights remain in dispute. August 1, 2012 Opinion or Order Filing 3 ORDER: The Plaintiffs application to proceed in forma pauperis is defective because he has not provided a certified copy of his inmate trust fund account statement for the six (6) month period immediately preceding the filing ofhis complaint as requi red by 28 U. S. C. § 1915(a)(2). Therefore, the Plaintiff shall submit to the court within thirty (30) days of the date of service of this order either a certified copy of his inmate trust fund account statement for the six (6) month period immediately preceding the date that he receives this order, or the full three hundred fifty dollar ($350.00) filing fee.
