MEMORANDUM AND ORDER: This matter is back before the Court on Plaintiff's motions to alter or amend judgment, to amend his complaint, and for appointment of counsel. (Doc. Nos. #8 , #9 , and #10 .) Because Plaintiff's proposed amended complaint successfully states nonfrivolous causes of action against individual defendants, his motions to alter or amend and to amend his complaint (Doc. Nos. #8 , #9 ) are GRANTED, and the Clerk is DIRECTED to reopen this matter on the Court's docket. Plaintiff's motion for appointment of counsel (Doc. No. #10 ) is GRANTED. This action is REFERRED to the Magistrate Judge to enter a scheduling order for the management of the case, to dispose or recommend disposition of any pretrial motions under 28 U.S.C. 636(b)(1)(A) and (B), and to conduct further proceedings, if necessary, under Rule 72(b) of the Federal Rules of Civil Procedure and the Local Rules of Court.
