Filing 6 ORDER: The 30-day period expired, and Plaintiff did not comply with the Court's instructions. Accordingly, this action is DISMISSED without prejudice for failure to prosecute and failure to comply with the Court's Order #5 . Plaintiff's motion to appoint counsel (Doc. No. #3 ) is DENIED as moot. He is therefore ASSESSED the full $400.00 filing fee. The Clerk of Court is DIRECTED to send a copy of this Order to the South Central Correctional Facility in Clifton, Tennessee, to ensure that the custodian of Plaintiff's inmate trust account complies with the portion of 28 U.S.C. 1915 pertaining to the payment of the filing fee. Filing 5 ORDER: Plaintiff filed an application to proceed in this Court without prepaying fees and costs (Doc. No. #2 ), and a motion to appoint counsel (Doc. No. #3 ). Under the "three-strikes" provision of 28 U.S.C. 1915(g), a prisoner is barred from filing a complaint in forma pauperis-that is, without prepaying the full filing fee-if he previously filed three or more cases in federal court that were dismissed as frivolous, malicious, or for failure to state a claim. Plaintiff is therefore ORDERED to pay the full filing fee of $400.00 within 30 DAYS of the date this Order is entered on the docket. Additionally, if Plaintiff does not comply with this Order, the Court will assess the filing fee against him and collect the fee from his inmate trust account. Signed by District Judge William L.
