Filing 7 ORDER Assessing Filing Fee $350 for Daniel Hailey. ORDER REFERRING CASE to Magistrate Judge Barbara D. Holmes. The Court has reviewed the complaint pursuant to the PLRA and, for the reasons set forth in the Memorandum entered contemporaneously with this Order, finds that the complaint states a colorable First Amendment retaliation claim under Section 1983 against Sergeant Singleton in his individual capacity. This claim may proceed for further development. With respect to all other claims and Defendants, the complaint fails to state claims upon which relief can be granted under Section 1983. Those claims and Defendants are DISMISSED. However, the Court will permit Plaintiff to amend his complaint, if desired, to more clearly articulate his deliberate indifference to serious medical needs claim under Section 1983. Consequently, the Clerk is instructed to send Plaintiff a service packet (a blank summons and USM 285 form) for Defendant Singleton. Plaintiff will complete the service packet and return it to the Clerk's Office within 30 days of the date of receipt of this Order. Upon return of the service packet, PROCESS SHALL ISSUE to the remaining Defendant. Plaintiff is forewarned that the failure to return the completed service packet within the time required could jeopardize his prosecution of this action. Signed by District Judge William L.
