Filing 12 USCA Case Number 20-6431. Case Manager Jill E. Colyer.(hb) |
Filing 11 ORDER: On November 18, 2020, the Court dismissed this action upon initial review of the Complaint. #4 and #5 . On December 18, 2020, Plaintiff filed a Notice of Appeal #9 and application for leave to proceed on appeal as a pauper #10 . The Court previously concluded that an appeal would not be taken in good faith and declined permission for Plaintiff to appeal as a pauper. (See Doc. No. 5 at 1-2). Accordingly, Plaintiff's application #10 is DENIED on that basis. Plaintiff may still apply for pauper status directly with the Court of Appeals for the Sixth Circuit. The Clerk SHALL provide a copy of this Order to the Clerk of the Court of Appeals. (xc: Pro se party by regular mail and emailed to Court of Appeals for the Sixth Circuit.) Signed by District Judge William L. Campbell, Jr on 12/22/2020. (kc) Modified on 12/22/2020 (kc). Modified on 12/22/2020 (kc). |

Filing 6 ENTRY OF JUDGMENT re: #5 Order Dismissing Case. (xc:Pro se party by certified mail. ) (kc) Modified on 11/20/2020 (kc). |
Filing 5 ORDER DISMISSING CASE: Because Lassiter's application to proceed as a pauper (Doc. No. 2) reflects that he lacks sufficient financial resources to pay the full filing fee in advance without undue hardship, it is GRANTED. Plaintiff's Section 1983 claims against Judge Puckett and Suzie McGowan based on the Due Process Clause of the Fourteenth Amendment are DISMISSED WITH PREJUDICE, and Plaintiff's Section 1983 claims challenging the substance of the Ex Parte Order are DISMISSED WITHOUT PREJUDICE. The Complaint is DISMISSED. This is the final Order denying all relief in this case. The Clerk SHALL enter judgment. Fed. R. Civ. P. 58(b). Because an appeal would not be taken in good faith, Lassiter is not certified to appeal the judgment in forma pauperis. 28 U.S.C. 1915(a)(3). Signed by District Judge William L. Campbell, Jr on 11/18/2020. (xc:Pro se party by certified mail. ) (DOCKET TEXT SUMMARY ONLY-ATTORNEYS MUST OPEN THE PDF AND READ THE ORDER.)(kc) |
