April 4, 2023 Opinion or Order Filing 6 MEMORANDUM AND ORDER: Plaintiff Curtis Daniel Hart, an inmate at South Central Correctional Facility (SCCF), filed a pro se civil rights complaint under 42 U.S.C. 1983 against Frank Strada, commissioner of the Tennessee Department of Correction (TDOC). (Doc. No. #1 ). Plaintiff also paid the filing fee. (Doc. No. #5 ). As explained below, this case may proceed for further development against Commissioner Strada in his official capacity only. All other claims and requests for relief are DISMISSED. This case is REFERRED to the Magistrate Judge. The only Defendant in this case is TDOC Commissioner Frank Strada. Plaintiff must ensure that Commissioner Strada is served with summons and the Complaint. The Clerk is DIRECTED to send Plaintiff a service packet (a blank summons and USM 285 form) and the Court's Information Sheet for pro se prisoners titled "Service of Process in Civil Rights Cases." February 28, 2023 Opinion or Order Filing 4 ORDER: Plaintiff Curtis Daniel Hart, an inmate at South Central Correctional Facility in Clifton, Tennessee, filed a pro se civil rights complaint under 42 U.S.C. 1983 and a declaration #2 requesting to proceed as a pauper. The declaration, however, is not accompanied by a certified copy of Plaintiff's inmate trust account statement for the 6-month period before he filed the Complaint, as required by statute for prisoners seeking pauper status. For this case to proceed, Plaintiff MUST either pay the full $402.00 filing fee in one lump sum or file a properly completed application to proceed as a pauper.
