April 24, 2023 Opinion or Order Filing 9 ORDER DISMISSING CASE: Paul Steven Murphy, an inmate of the Turney Center Industrial Complex (TCIX) in Only, Tennessee, filed this pro se action under 42 U.S.C. 1983 against Warden Jason Clendenion and Warden of Treatment Brad Cotham. Plaintiff filed a Motion for the Appointment of Counsel. (Doc. No. #3 ). Plaintiff also filed an Application for Leave to Proceed In Forma Pauperis (Doc. No. #7 ). From a review of Plaintiff's Application, it appears that Plaintiff lacks sufficient financial resources from which to pay the full filing fee in advance. Therefore, his Application (Doc. No. #7 ) is GRANTED. Plaintiff's earlier-filed Application (Doc. No. #2 ) is DENIED AS MOOT. The Clerk of Court is DIRECTED send a copy of this Order to the administrator of inmate trust fund accounts at the Turney Center Industrial Complex. [T]his action is DISMISSED. Plaintiff's Motion for the Appointment of Counsel (Doc. No. #3 ) is DENIED AS MOOT. This is the final Order denying all relief in this case. The Clerk SHALL enter judgment. Fed. R. Civ. P. 58(b). March 20, 2023 Opinion or Order Filing 5 ORDER: First, Plaintiff has submitted two complaints in this matter, one unsigned (see Doc. No. #1 at 1-11) and one signed (id. at 12-15). Accordingly, the Court cannot accept Plaintiff's unsigned complaint. The Clerk is DIRECTED to return the complete, original complaint to the Plaintiff. If Plaintiff wishes for the Court to consider the entire document submitted by Plaintiff (Doc. No. #1 at 1-47) as a single complaint, Plaintiff must sign and return page 11 within 30 days. Plaintiff's Application #2 is incomplete. Accordingly, Plaintiff shall submit the missing statement within 30 days of entry of this Order or, as described above, submit a written statement to the Court explaining why he could not comply with this Order. Alternatively, Plaintiff may submit the full civil filing fee of $402 to the Clerk of Court.
