Filing 5 ORDER: It appears from the application to proceed in forma pauperis that the pltf lacks sufficient financial resources to pay the $350 filing fee. Accordingly, the Clerk will file the complaint in forma pauperis. The pltf is herewith assessed th e civil filing fee of $350. In accordance with the Memorandum contemporaneously entered, the complaint fails to state a claim upon which relief can be granted. Consequently, this action is hereby DISMISSED. An appeal of the judgment rendered herein would not be taken in good faith. Therefore, the pltf is NOT certified to pursue an appeal of this judgment in forma pauperis. Signed by District Judge Aleta A. Trauger on 7/21/09. (reg & cert mail to pltf; cc: Warden at SCCC) (tmw) |
