October 21, 2016 Opinion or Order Filing 33 MEMORANDUM OPINION AND ORDER: Just as it did earlier, the Court concludes that Plaintiff has failed to identify evidence that presents a jury question on whether Defendant Mack Mechanical is (or was) an "employer" under the ADA. As such , its Motion for Summary Judgment 8 is once again GRANTED. The Clerk of the Court shall enter a final judgment in accordance with Rule 58 of the Federal Rules of Civil Procedure.
