ORDER: For the reasons explained in the Memorandum issued contemporaneously, Deft's 50 Motion for Summary Judgment which seeks summary judgment solely on Pltfs' federal claims is granted. Pltfs' claims under 42 USC 1983 for violation of the Fourteenth Amendment and their claims for deprivation of educational opportunities are dismissed with prejudice. The Court declines to exercise supplemental jurisdiction over Pltfs' state law negligence claim and that claim is dismissed without prejudice. Entry of this Order on the docket shall constitute entry of a final judgment in accordance with Federal Rules of Civil Procedure 58 and 79(a). Signed by Senior Judge Robert Echols on 9/12/08. (km)
